Lawrence O. Elliott, Jr. is the founder of Executive Title and Excrow, LLC. He, for the past years, has worked in real estate law as a settlement attorney for several years prior to starting Executive Title and Escrow, LLC.

Shortly after graduating from Howard University School of Law, Lawrence began focusing on a career in Real Estate and Public Interest. What does a title company do?

A title company oversees the interests of all parties - buyers, sellers, lenders and real estate agents - during the purchase or refinancing of a homeowner's loan. A title company performs title examination services (researching the ownership history of the property to determine that the title is free of any liens or claims), collects and distributes funds from the transaction, transfers ownership of the property and issues title insurance.

What is title insurance, and why do I need it?

Title insurance protects you, the property owner, and the lending institution that holds your mortgage from unforeseen claims that may arise against your property. Even though the exam performed by the title company is thorough, it is limited to public records. You need title insurance in the event that a prior owner of your property recorded a forged deed. If this has happened, the previous owner could come forward to claim ownership of the property at some point. Title insurance protects you against financial loss and the payment of legal costs associated with such false claims.

Do title companies charge different rates for title insurance?

Title insurance rates are set by state insurance commissions and are based on the purchase price of your property (your owner's policy) and the loan amount (the lender's policy).

Am I required to purchase title insurance?

Most lenders will require that you purchase a lender's title insurance policy. This protects their investment in your property. You are not required to purchase an owner's policy, but it is highly recommended that you do so. Your one-time title payment will protect your property for as long as you own it.
